BEAUFORT COUNTY, S.C. (WCSC) - Pine Island and St. Helena Island have been protected from gated communities, resorts and golf course developments for decades, but a recent lawsuit is challenging the county’s rules and leaders are getting legal advice on the next steps.
Even after hearing legal arguments, the county leaders voted 8-3 to reject any building proposals and back the rules that ban those developments.
In 2022, a developer proposed building a gold course on Pine Island. The historically Gullah Geechee area has been protected since the 1990s by a cultural protection overlay zone banning that kind of project, to preserve the integrity and history of the Gullah culture.
“It is unique. It was written by and for the people of St. Helena to protect their way of life the Gullah Geechee culture, because St. Helena is the highest concentration of Gullah Geechee landowners, it was designed to ensure that that is protected,” Coastal Conservation League South Coast Office Director Jessie White says.
Marie Gibbs is a fourth-generation resident of St. Helena Island. She stands with the Gullah Geechee nation and its supporters in asking for protection for their home.
“I’m so proud to be a part of this island culture, this island of South Carolina, and we do everything in our power to protect it. Our home, our legacy,” Gibbs says.
The Beaufort County Planning Commission and County Council voted in January of 2023 against allowing changes to the cultural protection overlay zone, seemingly killing the golf course and gated community.
Then in June of 2023, the developer, Pine Island Property Holdings LLC filed a lawsuit against the county. The lawsuit states some leaders supported their build and laid out ways to approve it or ways to modify the cultural protection overlay zone to approve it.
A petition with more than 5,000 signatures still showed a large community opposition to any changes allowing development previously prohibited.
“Beaufort County has gone through a long and arduous public process, hundreds of community members have turned out for many hours, late nights, and the county council made the decision to follow their rules, and so if they were to change their mind, now at this juncture, it’s really a betrayal of the will of the community, And it’s also setting a really dangerous precedent that, you know, the rules don’t matter,” White says.
White says it is refreshing to see eight of the eleven voting leaders back the rules they have in place.
“Beaufort County stood strong and stood behind the community and stood behind its own rules, and they’re on really solid legal standing in doing so. Courts generally don’t like to second guess the decision of local decision-making bodies and how they interpret and administer their rules.” White says.
For people like Gibbs, the decision honors her family’s roots and their work they put into tilling the land - land that they now own and want to be kept intact as a community.
“I tell people the fight was so long I was pregnant when it started. Now my baby’s walking, but it’s a journey worthwhile,” Gibbs says.
The developer’s lawsuit against the county is still active, but the community is taking note that leaders made a decision that many came out to ask for.
